The work for the approval of the “Community Law” of 2009 starts again today, in the Senate. Art. 42 (ex 43) concerning the need to adopt measures that do not cause a deterioration in the conservation status of birds and their habitats, as well as the need to adapt, as far as possible, the conservation measures envisaged for Special Protection Areas also to the habitats outside these areas. Furthermore, the article provides for a ban on hunting for each individual species during the return to the nesting site and during the nesting period and the stages of reproduction and dependence of the birds.
The changes made to the Chamber of Deputies also provide for the possibility for the Regions to postpone - to the first ten days of February - the terms of the hunting calendar (January 31) in other paragraphs and articles, subject to the opinion of the ISPRA to comply with. Also foreseen, in the proposed law, the possibility for the Regions to adopt temporary measures for the exercise of the exceptions referred to in art. 9, paragraph 1, letter A of Directive 2009/147 / EEC (especially that cause damage) in compliance with the guidelines that must be issued by Decree of the President of the Republic, on the proposal of the Minister of the Environment in agreement with the Minister of Agriculture, in agreement with the State Regions Permanent Conference. These are the most significant elements of novelty of the provision, compared to the current standard.
From today the “Comunitaria”, including the article in question (which in the Senate takes the number 42), resumes the discussion in the European Union Policies Committee and should already receive the opinion of the Constitutional Affairs Commission today. In the next few days, the opinions of the other Commissions concerned should be received and it is conceivable that by the month of May, the provision, now in its fourth reading, should arrive in the Chamber for definitive approval.
The "calm after the storm" represents the climate determined after the agreement found by the "Majority" and the Government, in the Chamber of Deputies, between the representatives of some hunters' associations (also in their functions as senator and honorable member) - and environmentalists going beyond the usual dramas, they seem to please everyone.
The balance point proposed by the center-right was also voted by a large part of the opposition, against Italia dei Valori. This was - according to the politicians friends of hunting - the only possible mediation and reached in the "Cesarini area" after months of demagogy and propaganda.
For some time, Arci Caccia had indicated the road to zeroing out all the bills under discussion in the field of hunting and the activation of a discussion table between the parties concerned, to be held in the open.
This was not the case and we fear it will not be. No one will answer - as always when it comes to hunting - for these agreements matured in secret for political and electoral exploitation. The clear demonstration is the stillness and silence of these hours. “After the feast, lu santo deceived”.
When the law is approved the problems will move to the Regions and already in the hunting calendars of this year as well as in the administrative measures that if they do not incorporate the new national rule will produce the multiplication of appeals to the Administrative Courts that will be entitled to decide "a lot" of the next hunting season.
This umpteenth lesson, especially for those who swore to "play them" who, on the other hand, "let us play" we hope will convince everyone to speak the language of honesty and responsibility. First, FACE is supported and applauded, which signs agreements (Brussels, 12 October 2004) with environmentalists to write laws that authorize only sustainable hunting in the countries (premises that are all found in the Community 2009 or in the Decree on the Pecorato / Prestigiacomo SPAs) , then we are represented by the politicians who organize the "friendly fire" and then we declare ourselves victims of the ladies who would have had our votes, then the Hunters Party that does not open its mouth in Parliament on the question of hunting times with the Deputy which represents them who, perhaps absent, do not vote.
Let us not complain if unity of convenience and ruthless competition continue to produce common evil and joy for no one.
In order not to be "subjects" and to suffer the limitations that are imposed on us (as if unable to understand those that are necessary and those that are not) it is better to deal with honesty, consistency and transparency and, if there are mediations to do, let's take responsibility by asking the other "stakeholders" to assume theirs in front of the Italians.
The number of anti-hunting "virgins" and extremists will be greatly reduced and will be a step forward for hunting to find some peace
