La self-defense in one's own home it should no longer be considered a crime: this is the extreme synthesis of a popular initiative that has been talked about a lot in recent days and which could change radically the protection of the domicile. It is a proposal from the party of theItaly of Values whose text is the following: "A popular law proposal to punish more severely the violation of domicile with a doubling of the penalties and to increase the possibility of legitimate defense without incurring culpable excess. With our proposal, those who enter private homes will know, therefore, to pay more severely and not to be able to transform themselves from aggressor into victim by asking for damages. For the same reasons, anyone who defends their own safety or property or those of others within their own home he will not be able to answer for his own conduct, not even by way of culpable excess in self-defense ".
The note then continues: "The legislative extension of the protection, also aimed at avoid the risk of fueling the "do-it-yourself sheriff" culture, ridden by extremist political forces in their tones but unproductive in their solutions, instead wants to constitute a stronger deterrent towards criminals ”. In practice, the amendment of two articles of the Criminal Code is being requested, 55 (the one governing negligent excess) and 614 ("Violation of domicile"). The goal is to increase the penalty to be inflicted, without forgetting another one, namely the impossibility for those who violate the domicile to seek compensation for the damage suffered.
The issue of home thefts and robberies obviously affects all private citizens closely, that's why the initiative is causing discussion. However, there is a bit of confusion, so some clarification is needed. Particularly, there are those who are convinced that the signatures for the referendum on self-defense can be collected in the municipalities of residence. In reality the local authorities know nothing about it, for the moment Italia dei Valori has simply put forward a proposal for a popular law.
As pointed out by the Directive Committee 477, born from the initiative of enthusiasts, collectors and operators in the arms sector after the approval of the law that imposes limits on weapons and their hunting use, if a real regulatory text is presented it will be necessary to consider the amendments which can improve the current situation. The proposal alone is not enough to produce effects and change the law that exists now, the concrete project can be presented with at least 50 thousand signatures, a collection that can also take place in the square and not exclusively in a municipal office or at the registry office.
