The regional resolution on thrushes
The hearing before the Milan TAR was scheduled for 20 October to discuss the suspension of the regional resolution that had authorized the sampling of the Song Thrush in the period 24-29 September, after the TAR itself had postponed the opening to 1 October. However, the discussion did not take place, since any pronouncement would have been superfluous since only the suspension of the resolution would have been discussed on October 20, which in any case had ceased all effect on September 30, and not the legitimacy or otherwise of the provision.
Interest on the appeal
The related legal issues will therefore be dealt with in the hearing on November 29, together with those relating to the opening dates and, above all, to the closing dates of the hunt for Tordo Sassello, Cesena and Beccaccia. The precedents tell us that, however, the TAR could also at that time declare that, with respect to the opening dates, there would no longer be a concrete interest in the decision of the appeal, as the dates have largely elapsed. However, it is hoped that the TAR will pronounce itself and above all that it will consider the technical and legal reasons that the Region had placed in support of its calendar.
The comment of FIDC Lombardia
"The crux in any case is the opinion of ISPRA, now less and less technical and increasingly oriented towards animal rights - observes the president of FIdC Lombardia Bertacchi -: now the indications of ISPRA on openings and closings are not based on the actual periods of hatching and rearing of offspring in late summer or on the actual start of spring migration, but on assessments such as the possible disturbance or the possibility of accidentally culling a specimen of an unhuntable species, and it is clear that in the face of decisions by TAR that the ministries to which ISPRA must refer to the ministries to which ISPRA must refer, endorse this slope which has very little of a technician.
