The orders of the Council of State
“The Council of State, with two different ordinances, one on the Tuscan calendar and one on the calendar of Sardinia, rejected the appeals of the anti-hunters, who asked for the reform of the precautionary orders of the respective TARs which in turn had already rejected the appeals. With these pronouncements, the regions of Tuscany and Sardinia will go hunting for thrushes, woodcocks and waterfowl until the end of January, unlike the Lombardy Region and what is requested by ISPRA, which in its opinions requests the advance closure to 31 December for the woodcock , on 10 January for turdids and on 20 for aquatics. It has finally been demonstrated that the ISPRA opinion is not binding and that well-motivated resolutions can allow you to go hunting as per article 18 of the national law, without having to adapt to the ISPRA opinion or to the Italian Key Concepts, which differ macroscopic compared to those of other EU countries”.
Comparison with Lombardy
"As regional councilor of Lombardy, the comparison with the Lombardy Region and the Assessorate that dealt with hunting came spontaneously: contrary to the two regions of Tuscany and Sardinia in Lombardy the calendar inexplicably started for ISPRA already reduced compared to the dates of law 157/ 92, therefore this Department had already decided to penalize Lombard hunters even before any TAR or CDS ruling. An incredible choice, worthy of opponents of hunting and certainly not of those who have declared themselves a friend of hunters. To this damage was added the insult of the delayed opening and early closures, as well as the renunciation of appeal to the Council of State after the order of the TAR and the slavish adaptation to the ISPRA opinion ".
A lesson to learn
“The Lombardy Region, which should be a national point of reference precisely for hunting and related industry, has renounced its role as wildlife and hunting manager, giving ISPRA the role of legislator and administrator which instead belongs to the Region. The Assessorate did not understand that giving up is useless, appeals arrive anyway and only by holding the positions of the national law can something be achieved.
