Creation of an autonomous entity
The story of the hypothetical is becoming more and more tangled Portofino National Park, a "National" Park that would have had the value of existing due to the beauty of the place, but only limited to that area which in 1935 established the government of the time (fascist!), creating an Autonomous Body whose institutive law was, ironically, the flagship of Italian and democratic protectionism! It is a pity that then with the subsequent passage to the Liguria Region (note well, in a truly democratic era!), it was not debased with its transformation into a Regional Park (and its consequent law!). Now they want to expand it at all costs and without any need from an environmental point of view, as the areas they want to add have no value WORTHY OF NATIONAL PROTECTION!
The real scandal
In reality, the main purposes for which it wants to expand and nationalize it are only two: one, to close other territories to hunting; two, enjoy state money (which will end up being spent on useless works or only useful for tourist activities, but certainly not for the "Conservation of nature"; which is the primary purpose of every National Park worthy of this denomination). But the real scandal is not this: it is the anti-democratic nature with which they want to establish it! In fact, there are now several sentences of the Constitutional Court (which is our highest legislative control body!) which have established that without the formal assent of the Municipalities – resolutions of the Municipal Councils – protected areas cannot be established. Yet the Liguria Region is blamed for "outrage at the stubbornly obstructive behavior put in place by the Administration up to now" while instead the stubbornness is, if anything, that of those who want the National Park at any cost, even that of going against the democratic rules and liberals established by the Constitution!
Ministerial Decree
On the other hand, it is the press organs themselves who confirm this, where they reported that «it was the Ministry that passed a decree by issuing unilateral measures from above, not shared, without taking into account the reasons of the local communities. In August 2021, the municipalities found themselves faced with a National Park imposed by a ministerial decree. It was precisely from the lack of listening and sharing of the ministry that all the judicial events started ». So, go ahead and bring everything to the Constitutional Court to understand who is actually right in this story. But let's see the reasons why this useless expansion of the National Park is "stubbornly" wanted, and then we ask ourselves, is this nature conservation or is it just an exploitation for other purposes? «…because of the Region, a Park that has enormous potential from an environmental and sustainable development point of view continues to be held at a standstill. Does the Region really intend to continue supporting only the Municipalities that do not want to be part of it and silence those who instead want to enter the Park?».
Constitutional Court
And again: "on the other hand, take into account the great economic driving force that the Park would bring to the territory". Here, it is not to obtain these things that National Parks are established! All the more so in a Region which already enjoys ample economic well-being thanks to its environmental, landscape and social status. But not only that, the very fact that there is a Monte di Portofino, Portofino itself and its coast, are amply sufficient for this satisfaction. Or is it not that in addition to the usual ban on hunting, the usual "treasure" of Roman money, there is not also the desire for a public apparatus where to insert locally appointed Presidents and Councilors, perhaps even environmentalists? So, to the Constitutional Court the arduous sentence! And it will not be "persistence", but democracy! (Source AIW)
