There has been a lot of talk in recent days of culpable excess of self-defense and of the Italia dei Valori initiative, a proposal by popular law to amend two articles of the Criminal Code. The idea that came to mind a Victor Fantozzi, mayor of Montecarlo (province of Lucca), now assumes a greater significance. As explained by Il Tirreno, the mayor signed a resolution to set up a very special fund: the money will be used to guarantee free legal assistance to all those citizens who will end up in court precisely for negligent excess following a robbery. Fantozzi has decided to implement the initiative after a theft in a bar in the Tuscan town, since yesterday there has been a regulation that explains how the contribution can be exploited.
The mayor does not believe it is "do-it-yourself justice", the resolution aims to discourage the robbers and their belief from entering people's homes without punishment. The fund will cover legal fees, with differences based on residence, annual income and the disputed accusation. The Municipality of Montecarlo wants to protect those families who are attacked at home and who could be sued by the robber.
The city is the first ever in all of Tuscany to make such a contribution to the budget. There popular proposal relating to self-defense immediately convinced the citizens of Monte Carlo to sign, so much so that in just one week there were more than 250 those that they went to the municipal offices to support the initiative. Fantozzi is also thinking about the constitution as a civil party of the Municipality in future processes to ask for damage to image and assets.
