Legal violation
This is a confirmation from a legal point of view, but it will end up sparking yet another debate on possession and revocation of a weapons licence. The Campania Regional Administrative Court confirmed the ruling according to which a man's shooting into the air to ward off some criminals who wanted to enter his house represents a violation of the Criminal Code.
How the events unfolded
Wanting to be even more precise, it is article 703 of this text (containing "Dangerous ignitions and explosions") that has been violated. The thieves attempted the robbery during the night after having climbed over the surrounding wall of the house. To chase them away, the protagonist of the story fired a shot into the air with his rifle, succeeding in his aim.
The reasons for the TAR
The withdrawal of the license took place immediately after the investigations, a decision contested by the owner himself. The Regional Administrative Court, however, confirmed the revocation, explaining how all the elements capable of casting doubt on the correct use of weapons are evaluated. The fired shot therefore represents one of the factors that correspond to incomplete reliability.
