User obligations
Both for the CB band (city band), and for the use of PMR (Personal Mobile Radio) and SRD (Short Range Devices) devices, it is necessary that the user presents to the Inspectorate competent for residence, the Declaration of Start of Activity, duly completed in all its parts and complete with the attachments described in the form itself. It should be noted that together with the application it will be necessary certify that the contribution of Euro 12,00 has been paid and attach a photocopy of a valid identity document. The forms relating to one's own region must always be used. LPD (Low Personal device) devices operating in the 433-435 Mhz frequency band do not require any declaration and contribution. The user who purchases or holds one or more of the aforementioned devices is required to notify the competent Territorial Inspectorate, through the DIA declaration. This declaration is "ad personam" and, unlike the old license to use the CB (the which extended to family members living together), the radio transmission activity is now considered to pertain to the “single” subject. The owner of the same therefore cannot give its devices to use to a person without a declaration.
The declaration contains personal information, indications regarding the characteristics of the equipment to be used and the commitment to observe specific obligations such as payment of the annual contribution, the observance of the safety, environmental protection, health of the population and urban planning regulations. Furthermore, the activity is not allowed to anyone who has been convicted of non-culpable crimes with a restrictive penalty exceeding two years, or has been subjected to preventive measures, as long as the effects of the measures last and provided that no rehabilitation sentence has been issued (art. 145 paragraph 2). It is important to keep a copy of the declaration presented and the receipts of the annual payments, for possible presentation to the Control Bodies. It is also specified that any variation of the elements referred to in the declaration and related documentation, it must be promptly communicated to the Territorial Inspectorate. The declaration can be sent by post, to the address "Ministry of Economic Development, Territorial Inspectorate of Tuscany via Pellicceria 3 50123 Firenze", sent by email to the address [email protected] or by fax to 055 2724340, or delivered by hand at the URP counters in Tuscany on the following days: Monday URP Grosseto at 9 / 12.30 - Tuesday URP Arezzo at 8.30 / 12.30, Wednesday URP Pisa at 9.30 / 12.30 - Thursday URP Florence at 9/13.
Annual contribution
The user must pay, regardless of the number of devices in use, an annual contribution, including the year in which the declaration referred to in Article 145 of the aforementioned Legislative Decree 259/2003 was presented, of Euro 12,00, by 31 December, with an extension of one month of each year (calendar year) by way of reimbursement of the costs incurred by the Ministry for supervisory, verification and control activities. The payment can be made on C / C nn100503 in the name of the Provincial State Treasury - Section from Florence indicating the reference year of the amount paid in the reason for payment or by bank transfer: cod. IBAN IT49 Y076 0102 8000 00000100 503. In the purpose of the transfer it is advisable to insert the exact name, address and year of reference of the fee, useful for recording the payment, as bulletins with multiple names or without names will be invalidated. The use of the city band is allowed as long as the contribution is paid. If you decide to cease this activity, it is sufficient to suspend the payment of the annual fee of Euro 12,00, automatically making the Declaration of Start of Activity expire. It is also advisable to communicate the cancellation of use to the Inspectorate, also by e-mail.
Controls
It is important to underline that a public official or a person in charge of a public service can request the owner of radio transmitting equipment to exhibit the documentation certifying the ownership of the use of the same, and to perform specific checks on the compliance of the equipment in possession with the characteristics, approval and conditions of the law. For this the user is obliged to show a copy of the Declaration (DIA) and a copy of the receipt of thepayment of the current annual contribution has been made. The surveillance is also carried out by the Judicial Police Authorities, as in the case of road checks, since the user can use the device on the car with special receiving systems (27 Mhz omnidirectional antennas) easily identifiable by the police.
