The Court of Justice of the EU has condemned Italy for the regional law of the Lombardy Region on hunting which authorizes, by way of derogation, the hunting activity of four protected species: finch, brambling, pipit and frosone. The judges accepted the objections of the European executive, recalling that the Community legislation on the conservation of wild birds must be interpreted in the light of the precautionary principle, which is one of the foundations of the protection policy pursued by the European Union in the environmental field. . Considering that the law transposing the European directive concerning the conservation of wild birds into the Italian legal system, "is not completely compliant with this directive" and that "the transposition system of art. 9 of the latter does not guarantee that the exceptions adopted by the competent Italian authorities comply with the conditions and requirements set out in this article ", the judges have established that Italy" has failed to fulfill its obligations ". Therefore - the judges ruled - "the Italian Republic is ordered to pay the costs, including those relating to the summary proceedings".
