La LAC, after having filed an appeal against the void, or against the fact that the Region has not suspended the hunt (before it opens) due to the state of drought, on 11 August it notified another appeal challenging the hunting calendar of Lombardy. The appeal will be discussed on 8 September (along with that for drought) and obviously the LAC has asked for the suspension of the collection of all huntable species. The appeal is based on assumptions and circumstances far from reality and presents the judges with a reconstruction which, in order not to risk lawsuits, we limit ourselves to defining false.
1) The LAC claims that the Region has not adopted the calendar with an administrative act, but with the 2004 law ten years that the TAR itself rejects this ground of appeal because it is unfounded ... Moreover, the same appeal against the calendar demonstrates that the calendar is adopted with an administrative act ...
2) Even according to the LAC, the calendar would have been adopted WITHOUT AN ISPRA OPINION (received by the Region in early April ...): paradoxical that one then complains that there has been a deviation (ONE).
3) The LAC generically denies that the Region would have foreseen the general opening on 18 September, while ISPRA would have given an indication for October 1st: the calendar is known to foresee a partial opening on September 18th, and the general opening on October 1st.
4) According to the LAC, the Region, after having foreseen the suspension of the collection of 5 species, would have foreseen a reduction of the game bag only for pintail, blackbird and woodcock, forgetting about quail and lark and keeping in mind that ISPRA has not given indications of a reduction in game bags for the other species that have remained huntable (which in any case have well-known game bag limits, from sedentary to all migratory species.
5) The LAC complains that the Region has authorized all hunters to take 2 heads of sedentary and 30 migratory heads every day for the entire season, thus authorizing Lombardy hunters to shoot at least 90 million heads of each species! (which is ridiculous): in the reconstruction of the LAC each Lombard hunter on the same day could in fact collect 30 animals for small migratory species and 10 animals for each species of waders and ducks, in addition to the sedentary and two woodcocks !!!
6) The LAC even claims that the Region has not carried out any investigation on the state of conservation of the huntable species and on the history of the game boxes, but produces in its appeal the tables drawn up by the Region precisely on these points and reconnaissance of the game bags from 2002 to 2020! And obviously the fact that the calendar has been subjected to an Environmental Impact Assessment is silent, so the compatibility of the forecasts was thoroughly assessed also with regard to the Natura 2000 sites.
7) The same LAC then uses the data of the multi-year withdrawals of the Region to argue that the decrease in withdrawals depends on the decrease in species: except that it is obvious that if in 20 years the hunters have halved, seasonal withdrawals have halved...
In the end, the only reason for appeal in which the LAC complains the deviation from the opinion of ISPRA concerns the closure in Sassello and Cesena: scheduled for January 20 and not for January 10 as suggested by ISPRA ... The rest is only and only incorrect and distorted presentation of Lombard hunting planning, aimed at obtaining the closure of all forms of hunting, although the only concrete reason for appeal concerns 10 days of hunting for sassello and cesena in January. Federcaccia Lombardia on 8 September will be at the TAR with its lawyers, alongside the Region, to give the judges the correct legal and regulatory framework in which hunting takes place in Lombardy. At the moment, however, both the dog training and the pre-opening, where foreseen, will start as scheduled (source: FIDC).
