Il Salerno Regional Administrative Court has brought back the discussion concerning the lack of motivation when imposing the prohibition of possession of weapons. This same prohibition is vitiated if the connection between the crimes committed and is not justified the unreliability of those who possess weapons. The offenses in question are those that do not have to do with the use of rifles and pistols.
The Campania Regional Administrative Court explained how there are flaws in the ban in case of "poor" motivation, therefore, when the correlation between aggression, violence and unreliability and the crimes committed are not explained. The case examined was that of a man who had not obtained the clearance to keep five rifles and some cartridges at home. following the death of his father.
The appeal to the administrative court went positively, as the judges did not identify the possible risk of gun abuse. The crimes committed before the ban concerned the sale of psychotropic substances (such as LSD) and the stabbing port. The man has shown adequate moral and civil conduct. In a nutshell, the criminal responsibilities were not considered current, given that in the meantime rehabilitation intervened and the subject's prevailing conduct was good.
