Il TAR of Sardinia, by collegial order Sec. I, 17 October 2019, n. 262/2019, has definitively partially suspended the Sardinian regional hunting calendar 2019-2020 About the wild rabbit hunting. Here is the motivation: "" The opinion ofISPRA has, by constant jurisprudence, a central importance in the preparation of the hunting calendar and can be disregarded on the basis, however, of a reasonable motivation that justifies, also in terms of logic and reasonableness, the different preferred solution (Council of State, Section III, no. 3852 of 22 June 2018).
Even if we want to consider the indications given by ISPRA for hunting wild rabbits purely programmatic, however these indications highlight the need to a careful and immediate evaluation of the effects of the withdrawal on biological sustainability ", however," although the Region has set (with the contested decree) a numerical limit, both daily and overall, on the number of animals that can be killed, however, it does not appear that this number has been commensurate with the dynamics of the population and adoption of control mechanisms on the effects of the levy ", it follows" that the indicated numerical limits appear to be very high, in relation to the number of potential hunters and also taking into account the number of animals that have been taken in the last hunting seasons ".
