The order issued by the TAR of Tuscany concerning the appeal presented by environmental and animal welfare associations regarding the hunting of the species Tortora, Moriglione and Pavoncella. The TAR accepted, and therefore confirmed theprecautionary request, suspending the effectiveness of resolutions n ° 785 and 786 of 02/08/2021 concerning specifically the hunting the species pochard and lapwing, while setting the discussion on the merits at the hearing scheduled for March 2, 2022.
Hunting for the above species therefore remains suspended.
Below is an extract of the reasons expressed by the judges of the second section, pending the discussion on the merits:
"Considered:
a) with regard to the appeal of the DGR n. 691 of 5 July 2021 limited to hunting of the Tortora:
- which with the addition of DGR n. 943 of 13 September 2021, the withdrawal of the aforementioned species for the hunting season 2021/2022, thus ceasing the relative matter of the dispute;
b) with regard to the appeal against the DD.GG.RR. nos. 785 and 786 of 2 August 2021, concerning, respectively, the hunting of species Lapwing and Pochard:
- that the regional determinations seem to conflict with the conclusions reached by this same Court in judgments no. 848 of 30 June 2020 and no. 632 of May 4, 2021, regarding the huntability of the species in question in previous hunting seasons;
- that the suitability of the named plan appears doubtful "International Multi- Species Action Plan for the Conservation of Breeding Waders in Wet Grassland Habitats in Europe 2018 - 2028", valued by the administration in resolution no. 785 of 2 August 2021, to act as a management plan and to ensure that the hunting activity does not explain negative effects on the conservation of the Lapwing;
- that not even the set of general measures adopted by the Region for the organization and regulation of hunting in the Tuscan region, may make the adoption of the aforementioned specific management plan superfluous; "
