The facts in detail
The one addressed by the Regional Administrative Court of Sicily is a truly singular affair. The judges in fact rejected the appeal of a hunter originally from Palermo who wanted to see his gun license returned. The latter had been denied to him following the burglary suffered at home, with the thief capable of breaking down the safe cabinet with the weapons stored inside and taking it away without much ceremony.
Unlawful use of weapons
The behavior of the robbed person was deemed by the TAR to be liable to the undue use of the weapon, with theomitted custody considered as such despite what was done by the thief who laboriously removed the safe. This is a precedent that is already causing discussion and is destined to attract new controversies over the next few months.
The reasons for the appeal
These were the reasons for the hunter's appeal: "The Administration would have based the decree on non-existent and irrelevant elements to determine the revocation of the rifle carrying license and would not even have carried out any investigative activity even in the context of summary information and preliminary investigations. Furthermore, it would not have taken into account the fact that the appellant suffered theft in his home through the removal of the entire safe cabinet, anchored to the wall, containing the legally held and adequately guarded rifles and would not have suffered the theft of the individual weapons".
