The Veneto Regional Administrative Court rejects the League's appeal for the abolition of hunting and implicitly reopens hunting as an exception to non-huntable species; satisfied Hon. Berlato for confirming the validity of regional legislation.
The TAR of the Veneto rejected the appeal of the anti-hunts that asked for the cancellation of the regional resolution that allowed hunting in derogation in Veneto, in application of art. 9 of Directive 147/2009 / EEC, of state law 221/2002 and of regional law n.3 / 2002, as amended in 2005 and 2007 at the request of the European Union. The Veneto Regional Administrative Court therefore confirms the soundness of the regulatory framework that has allowed the correct application of the derogation regime in Veneto from 2002 to today.
Those who affirmed that the temporary suspension of hunting in derogation in Veneto, decreed by the TAR at the beginning of October, was due "to the cunning and subterfuge of those who had administered the hunting department in previous years", is thus blatantly denied.
There remains the regret on the part of the hunters of the Veneto for having been deprived of the right to hunt in derogation in the best month of the pass of migratory species, a privation for which neither the judges of the Tar, nor the unsuspecting regional councilor for hunting Stival, nor the coupled Federlega can foresee, even if it would be more than fair to ask them, any kind of compensation.
The facts show us that if even for the 2011 hunting season the exceptions in Veneto had been applied by law, as happened from 2002 onwards, the hunters could have hunted continuously this year as well as happened in Lombardy where, by copying what done by the Veneto in recent seasons, Lombard hunters have been able to hunt without interruption in full compliance with the law and Community Directives.
From tomorrow, Saturday 5 November 2011, the green light will then go to hunts in derogation in Veneto, hoping that next year the Federlega pairing will not instigate the unsuspecting regional councilor Stival to return to commit the same mistakes made this year.
