Weapons: CPA Sardegna's clarifications on the renewal of the firearms permit that has expired for over ten years on the basis of the amendments to Article 5 of Law 110/75.
Legislative Decree 26 October 2010 n. 204 - Implementation of Directive 2008/51 / EC, relating to the control of the acquisition and possession of weapons and amendments to the laws on weapons (GU 10 December 2010 n. 288); Art. 5 (Amendments to law no. 18 of 1975 April 110) d) in the sixth paragraph of article 8 after the words “Those who”, the following are inserted: “in the ten years prior to the presentation of the first application”. Note: The provision therefore becomes “The provisions referred to in the preceding paragraphs also apply to persons who represent, pursuant to article 8 of the aforementioned consolidated act, the holder of the police authorization. Those who in the ten years prior to the presentation of the first application have served military service in the Armed Forces or in one of the Armed Corps of the State or have belonged to the roles of civilian personnel of the public security as officials or who exhibit a certificate of suitability for handling of weapons issued by the competent section of the Federation of national target shooting must undergo technical assessment only for the exercise of the activities of manufacture, repair or trade of weapons. "
It seems to mean that for the simple purchase or carrying of arms, non-discharged soldiers or former soldiers, former PS officials, persons already in possession of a weapons handling certificate, will not have to renew the certificate as long as ten years have not elapsed from the moment. in which they have ceased to have arms licenses. This would be the logic of things, but it is not possible to understand what is meant by "presentation" of the first instance.
According to the letter of the law, it should be concluded that whoever has an expired firearms license and keeps it (expired) for 10 years, in case of renewal, will have to take the exam and shooting in an authorized shooting range again, the qualification exam. hunting instead it is always valid. So whoever has had the license for 10 years, should redo the gun handling which is purely absurd. But after all, the very rationale of the rule is absurd: what to do if one has hunted abroad or shot in the cellar? Some think that over time the rules of prudence in the handling of weapons are forgotten (education at the TSN has no other purpose).
