The reply from the Prefecture of Bergamo to the request for Federcaccia Bergamo signed by the President Michael Bornaghi, which clarifies the possibility of carrying out maintenance actions a huts and roccoli.
"With reference to the request of 9 May last, with which the possibility of proceeding is requested, in force the current legislation for the containment of the COVID 19 epidemic, to the maintenance of hunting sheds and roccoli, we specify the following. In the absence of a specific rule governing the maintenance of the structures instrumental to hunting, an analogue reference to similar provisions of the emergency legislation seems appropriate.
To this end, it should be noted that the Prime Ministerial Decree of April 26th allows, pursuant to art. 2 paragraph 8, the carrying out of maintenance and conservation activities for companies whose production activities are suspended. The maintenance activity is also allowed as a legitimate reason for access to second homes. The rationale of the legislation therefore appears to be to allow the maintenance activities relating to real estate in order not to jeopardize its value and subsequent use by the legitimate owner.
In this sense, the maintenance and conservation purpose justifies a derogation from the general limitation of access to certain real estate for epidemiological containment reasons. A similar rationale seems to support access to hunting sheds and roccoli which, in the absence of maintenance, could be jeopardized when hunting is permitted. This conservation activity can be carried out in compliance with the sanitary regulations in force as regardsuse of personal protective equipment and the prohibition of gatherings. It will also be necessary to explain this reason for moving within the regional territory, by filling in the appropriate form self-certification downloadable from the Prefecture website ".
