Caccia / Galan: To the Minister of Agricultural, Food and Forestry Policies - To know - given that:
On 7 October 2010, the State-Regions Conference approved the report on the state of application of Law No. 157 of 1992, “Regulations for the protection of wildlife and for the exercise of hunting”;
the aforementioned report is specifically provided for by paragraph 1 of article 35 of the aforementioned law number 157 of 1992; from what was reported, also in the press, by some hunting associations, it seems that this ratification took place without the prior opinion of the National Wildlife - Hunting Technical Committee (Ctfvn), despite the fact that Article 8 of Law 157 of 1992 confers on this Committee tasks as a technical consultative body for everything concerning the correct application of the legislation in question (paragraph 3);
The National Wildlife - Hunting Technical Committee (as provided by paragraph 1, article 8 of Law 157 of 1992) is composed "of three representatives appointed by the Minister of Agriculture and Forests, by three representatives appointed by the Minister of the Environment, by three representatives of the regions appointed by the Permanent Conference for relations between the State, the regions and the autonomous provinces of Trento and Bolzano, by three representatives of the provinces appointed by the Union of Provinces of Italy, by the director of the National Institute for Fauna wild, by a representative for each recognized national hunting association, by three representatives of the most representative agricultural professional organizations at national level, by four representatives of the environmental protection associations present in the National Council for the Environment, by a representative of the Italian Zoological Union , by a representative of the national body for Italian dog lovers a, by a representative of the International Council for Hunting and Game Conservation, by a representative of the National Body for the Protection of Animals, by a representative of the Italian Alpine Club ";
It should be noted in this context that in the course of the previous meetings of the Technical Committee for wildlife - hunting (as far as the questioners are aware, also following precise reports of representatives of hunting associations present) both the then Minister of Agriculture Luca Zaia, and the delegates of the same dicastery, had assumed specific commitments regarding the involvement of the Committee in order to safeguard its consultative functions. The Committee, through its members, should and could thus have expressed an opinion before the presentation of the text for the resolution of the State Regions Conference. Act which actually precedes the delivery of the report itself to Parliament;
Since it is almost a year (precisely from 2 December 2009) that the Wildlife - Hunting Committee has not been convened, the conditions do not objectively seem to exist for the Committee itself to have been able to fully carry out its functions and express its opinion on the report relating to the state of application of Law number 157 of 1992 (which, as already mentioned, was approved on 7 October by the State Regions Conference);
On the contrary, we note that the “Animal Friendly” Committee has recently been set up at the Ministry of Tourism. A body that has expressed itself on numerous occasions on the subject of hunting access to agricultural funds and hunting activities, and which, from the statements that emerged in the press, would be proposing a bill to amend the rules governing access to private funds. At the moment, there are no representatives of the hunting associations, Ispra, as well as the other components envisaged by law 157 of 1992 (which are already part of the National Wildlife Hunting Technical Committee) on this Committee;
From what has just been explained it is therefore clear that we would be in the presence of a clear violation of a state law: the Technical Committee for wildlife - national hunting is in fact deprived of its functions while guidelines and planning on hunting are taken on by a new committee set up. from another dicastery that is not related to this matter by competence.
If what stated in the introduction is true: if therefore the National Wildlife - Hunting Technical Committee has not been convened for about a year and if consequently it has not been able to express its opinion, as required by current legislation, on the report on the state of application of the Law number 157 of 1992;
if it does not deem it appropriate to convene the National Wildlife-Hunting Technical Committee in a short time in order to safeguard its consultative functions in relation to political and programmatic guidelines in the field of hunting;
Whether the "Animal Friendly" Committee, set up by the Ministry of Tourism, has specific competences within the government in matters of hunting and, if so, what urgent measures it intends to take to prevent other departments from unilaterally assuming roles and functions not provided for by the national law in force and clearly the responsibility of the Minister of Agricultural, Food and Forestry Policies.
