The TAR of Emilia Romagna rejects the appeal of environmentalists on the regional hunting calendar: the opinion of ISPRA is not binding.
With its own order filed on July 26, 2012, the Regional Administrative Court for Emilia Romagna rejected the appeal against the Regional Hunting Calendar presented by the environmentalists of the Lac and Lav associations.
In particular, the appeal presented by the environmentalists asked for the suspension of the resolution of the Regional Council n.273 of 14 March 2012 on "Regional hunting calendar, guidelines and prescriptions for the preparation by the Provinces of provincial hunting calendars", of the resolution of the Provincial Council of Modena n.149 of 15 May 2012 containing “Provincial Hunting Calendar for the 2012-2013 hunting season and all the documents connected to them according to the prescriptions and indications provided.
The reasons for the appeal presented did not convince the judges of the Regional Administrative Court, which therefore decided to reject the same and the request for suspension contained therein "considering that there are no concrete and detailed hypotheses of serious damage and that, moreover, no profiles emerge that may lead to the acceptance of the appeal taking into account in particular both the non-binding nature of the opinion of ISPRA, in the part concerning the use of new devices, and the extraneousness of the issue to the hunting calendar; the fixing, for the hare, of a quantitative ceiling for the daily and seasonal game bag; the lack of impact on the collection of the fauna of dog training; the existence of a regional power to derogate from the hunting periods of ungulates which is also justified in the particular collection methods established by the region by species ".
