The TAR of Brescia has postponed the judgment on the hunting calendar allowing in fact the continuation of the hunt in the provincial territory of Bergamo.
Satisfaction from the Province who commented in a press release, "It is with great satisfaction that the Province of Bergamo takes note of the decision of the Brescia Regional Administrative Court which postponed the judgment on the current hunting calendar allowing the continuation of hunting in Bergamo, as desired from the Province and the hunting world, to protect what we consider an important tradition of our territory ". The Province of Bergamo then announces that it will continue in its action in defense of the rights of hunters also for the importance they play in environmental protection, despite the contrary opinion of the WWF.
Already on November 6, the TAR of Brescia on November 6 had agreed to the WWF on the appeal filed against some contents of the Hunting Calendar such as the integration of the two days of hunting from fixed stalking and hunting in the snow in the territory of mountain communities; in defense of the Calendar in the dispute the Region, the Province of Bergamo and the national Arcicaccia hunting association.
Pending the assessment of merit scheduled for today 5 December, the TAR had satisfied environmentalists by placing a suspension on the Hunting Calendar in the parts concerning the issues of the appeal. According to the WWF, the Province of Bergamo would not have taken into account the opinion of ISPRA, the Higher Institute for Environmental Protection and Research, granting hunters two additional half-days of hunting for the months of October and November, thus subjecting migratory species to one stress of five out of five days of hunting.
In its own press release, the WWF expresses great satisfaction for the maintenance of the precautionary measures already adopted by the Brescia TAR, regarding the suspension of hunting in the snow and the days of migratory hunting, which will remain in force until January 16, 2012 when the next hearing ".
The WWF then launched an ultimatum to the Province of Bergamo to restore "hunting legality by January 16, setting the calendar and the plan, reintroducing the 7.000 hectares of protected territory that are missing and reconfiguring the oases of protection with adequate dimensions (respecting the two sentences already issued by the Brescia TAR); if the provincial administration does not comply with the requests, the WWF “will not hesitate to ask for the appointment of an ad acta commissioner, who will rewrite the rules of hunting in the Bergamo area, replacing the defaulting Province. The protection of nature and respect for the laws ask for more ”.
