A topic that has been debated for years now is that of the competence of the security guards of the animal welfare associations. Several court rulings have ruled that none of these guards can carry out checks on hunters unless specifically authorized with provincial decree. Today, an official note from the Umbria Region also recognizes it, at the end of a long dispute between Wwf and Libera Caccia.
The Region of Umbria, with an administrative provision signed by the manager Stefano Strona, in fact accepted the observations contained in the defense brief that the lawyer Marzio Vaccari had forwarded on behalf of theNational Free Hunting Association of Umbria against the report (for almost 15 thousand euros) that volunteer guards of the WWF of Perugia had raised against the regional president of the hunting association, Lando Loretoni, for alleged violations during a dog training event which took place in the Zac area of Camposalese in Spoleto. In accepting the appeal, the Region motivates the provision by writing that "the minutes taker was not in possession of the provincial security guard decree on the matter fishing and hunting".
And this, we read in the motivations of the region, given the latest interpretations of the jurisprudence on the subject, after having acquired the note from the Prefecture of Perugia "which affirms the non-competence to issue / renew the decree to voluntary security guard for hunting surveillance”, As well as that of the Regional Service for Hunting Wildlife Planning and the opinion of the Regional Legal-Legislative Affairs Service. "As we have reported for two years to the competent authorities - explains the lawyer Marzio Vaccari - the voluntary sworn guards without the decree issued by the Province of Perugia they cannot carry out controls on fish-hunting matters, much less raise fines and seize weapons and game.
Now - continues the lawyer Vaccari - we expect that, as a result of the investigation carried out for this case, the Province will declare in self-defense to declare the sanctions imposed by guards who were not entitled to be null and void (and the Region archives all related proceedings). Without therefore having to force the hunters unjustly hit to have to spend money, in addition to the inconvenience suffered, to enforce their rights. I also hope and hope that the Province of Perugia - concludes Vaccari - decides to appear as a civil party in the criminal proceedings against these gentlemen to be held in 2020 before the Court of Spoleto ”.
