Il Council of State, deciding on the merits of the Ligurian Hunting Calendar of the last season 2018/19, and on the relative sentence of TAR, established that the regional reasons for the departure from the opinion ISPRA for the woodcock species have been corrected and has therefore decided that the closure on 20 January is legitimate. A gratifying result for Ligurian and Italian hunters, for the Region and for Federcaccia and Friends of Scolopax, since the reasons for the regional resolution include our work on woodcock satellite telemetry and the data presented at Pico Island at the 2017 congress.
The Council of State specifically mentions our work in support of regional choices considered valid. It should be remembered that the TAR Liguria had instead fixed the closure of the hunt for the species on 31th December. The Council of State has therefore finally considered correctly the role of the Region in the wildlife-hunting management and its full legitimacy to depart from the opinion of ISPRA with suitable reasons. On the other hand, the decision of the Regional Administrative Court which concerned the closure of the Redwing Thrush has not been changed, since the Council of State strictly considers the decade of overlap, considering that the Region must in any case insert reasons that confirm a delay in the start of the migration with respect to the data Key concepts.
Although this interpretation is different from what is written in the European Hunting Guide, Federcaccia expresses satisfaction with the result which confirms the value of the research undertaken and thanks the Liguria Region for the commitment in the judicial field and the collaboration with our offices, and the lawyers who have achieved this important success.
