With regard to the reasons expressed by the judges in their order, Stival wishes to underline the part in which it is indicated that "the motivational apparatus of the contested provision, with regard to the environmental, faunal and biological reasons relating to the" local context "justifying the failure to implement the indications contained in the ISPRA opinion, appears to comply, also in consideration of the additions adopted in the meeting of 11 October 2012, to criteria of logic and relevance that cannot be criticized under any of the profiles deduced with the appeal ".
"To this - Stival points out - is added that the TAR recognizes the correct choice of the Region not to request a further opinion from Ispra, clarifying from every point of view that the guide provided by Ispra itself for the compilation of calendars, as well as the classifications according to the Special of European Conservation Concern system, have no normative value and therefore cannot be used to assess the legitimacy of a provision ".
