The presidents of the hunting associations and federations of the sports sector ask the Minister of the Interior, Annamaria Cancellieri, for clarification on the changes to the legislation on weapon ports.
In a joint letter, the Presidents of the Hunting Associations and Federations of the sports sector wrote to the Minister of the Interior Annamaria Cancellieri asking her to better clarify the modification of article 42 Tulps which took place with the publication of the decree law "Urgent provisions on simplification and development ”in order to avoid the generation of possible interpretative confusions regarding the duration of the validity of weapon ports for hunting and sports use.
This is the text of the letter:
"The Presidents of the undersigned Associations and Federations of the sports and hunting sector: ARCICACCIA, CNCN, EPS, FACE ITALIA (FIDC, ANLC, ENALCACCIA, ANUU Migratoristi), FIDASC, FITAV, ITALCACCIA, UITS who, having found that:
• on 9 February 2012 it was published in the Official Gazette no. 33, Decree Law no. 5 “Urgent provisions on simplification and development”.
• in art. 13 of the aforementioned Law Decree, amendments to the TULPS regulations are envisaged. With the modification of article 42 TULPS it is established that "the license is valid for one year".
This rule has the clear purpose of removing the defense weapon license from the application of the renewed article 13 of the TULPS and maintaining the duration of one year for it. However, the provision risks having the effect of causing a general reduction to one year of the duration of all firearms licenses. Moreover, this provision could be considered as a modification of the rules defining the duration of hunting and shooting licenses, with the same result.
This effect would be completely contrary to the rationale of the rule, specifically aimed at administrative simplification, and deleterious for the future of the hunting sports sector. They therefore believe:
that it is essential to specify more clearly the news referred to in letter b) of the first paragraph of article 13 of the law decree no. 9, specifying that it applies to licenses “whose duration is not otherwise established by law”.
Given the importance of the issue, the Federations and Associations agreed, through their Representatives, ask for an urgent investigation of the situation and that a corrective amendment to the Law Decree be presented in parliament to avoid any erroneous interpretations with respect to the will expressed by the Ministry. of the Interior and has always been in force in univocal terms.
