Assoarmeri has decided to update the provisions and behaviors that must keep the armories in our country in the light of the Dpcm launched last November 3 and the red, orange and yellow zones established later to differentiate Italy on the basis of infections. Here is what is reported by the same association on the matter: "Assoarmieri, as anticipated, promptly intervened at the Ministry of the Interior to confirm its interpretation of the contents of annex 23 of the Prime Ministerial Decree regarding "Retail Trade", which identifies all the activities for which closure in the "red" areas is excluded (scenario type 4) and which makes express reference, among these, to the Commerce to the detail of sporting articles and articles for the free time in specialized exercises.
In our opinion, also based on the interpretations of the lawyers of ANPAM file and Caesdea (Center for the Study of European Law on Weapons), gun shops fall within this category and therefore, to the extent that they carry out retail sales of sporting goods and leisure items, they can also remain open in the so-called “red” regions. This is even more true for those armories that have, among the ATECO codes of its business, including that relating to the sale of sports products. To this we add that, even for the areas identified in the "type 4 scenario" mentioned in Article 3, in the "further measures to contain the contagion on some areas of the national territory characterized by a scenario of maximum severity and a level of high risk“Production activities are not indicated as suspended (and this is the essential element).
Having acknowledged that the prevailing activities of the armories on the Italian territory and in particular in the red areas pertain to that business activity which is the "repair by means of a complete mechanical overhaul and refurbishment of weapons" and that this activity falls into the category general of the “repair, maintenance and installation of machines and equipment", On the basis of these premises of a legal nature, Assoarmieri suggests to each single armory that wishes to carry out its own weapons testing activity by moving from the armory site to the identified firing ranges, to ask the local prefectures for authorization to proceed, considering this activity in the "Proven work needs" referred to in Article 3 paragraph 4 letter a) of the aforementioned Prime Ministerial Decree, always in strict compliance with the safety and distancing requirements required and ordered by the current epidemiological emergency from Covid -19.
For the purposes of an effective and correct implementation of the measures, it will also be essential that all the activities carried out in this context by the armory to adapting to these requirements is matched by adequate reporting of the controls and actions implemented.
