Stop the hunting of the lapwing species in Basilicata. It was decided with a sentence the TAR that accepted the appeal of the "Victims of the Hunt" association presented against the Region. In the appeal, the association, defended by the lawyer Massimo Rizzato, asked for the cancellation of the resolution of the regional council, the 565 of last July 19, concerning the adoption of the hunting calendar for the 2021 / 2022 season as regards the hunt for the lapwing, a medium-sized bird very common in Italy and Europe.
The association stressed the fact that, despite the notes of the European Commission and the Ministry of the Environment not to include these species in the hunting calendars, the Basilicata Region has done so anyway, according to the association, violating international and community obligations. The Region, notified, did not appear in court. For the TAR, the appeal is well founded for the reasons set out. In particular, the sentence also reports the fact that the lapwing species has been included in a bird conservation area that prohibits its hunting. So much so as to oblige Italy, in the context of an international agreement, to adopt all the bird conservation measures, especially those most threatened.
For the TAR, “the Region should have previously implemented it administratively the actions necessary to safeguard the lapwing, through the adoption of a valid management plan ". And, accepting the reasons presented by the association, the appeal was accepted with the cancellation of the hunting calendar of the Basilicata Region 2021/2022 in the part where it has admitted the lapwing among the huntable species. In addition to the acceptance of the appeal, the extending judge Paolo Mariano and the first legal secretary Benedetto Nappi sentenced the Basilicata Region to pay the costs of litigation for 1.350 euros.
