He gets caught onisland of Ischia in the company of a dependent person prejudices for drug use and his firearms license is revoked. It happened to a man residing in the Province of Caserta who proposed appeal to the Tar against the Ministry of the Interior for the annulment, after suspension, of the provision of the Prefect of the Province of Caserta with which the applicant was banned from possessing weapons, ammunition and explosive materials; of all previous, presupposed and consequential acts. The man has been revoked the firearms license for his unreliability in the use of firearms why he would have been responsible for a traffic accident under the influence of alcohol; because pinched with packaged marijuana and because on December 29, 2015 it was controlled in the city of Ischia in the company of a dependent subject for drug use.
Man has put in place the appeal for "the illegality of the provision due to absolute lack of investigation and motivation, also in relation to the counter-arguments formulated at the outcome of the communication of the initiation of the procedure, in relation to which the Administration had expressed nothing regarding the reasons of irrelevance for the purposes from a decision of a different nature". For the appellant "Furthermore, the check carried out in Ischia together with a subject including previous police records would be completely irrelevant, since it was an employee of the same company for which he worked it recurring and having been the check carried out at the time of delivery of some furniture on behalf of the same company ".
But for the administrative judges "The complaints articulated in the appeal are well founded, since in the specific case the measures encumbered are not supported by an appropriate assessment of the factual elements, already indicated above, which, in the opinion of the Board, for the purposes in question, they do not appear suitable to justify the judgment of unreliability expressed by the resistant Administration ". For this reason the judgment was upheld with the consequent annulment of the provision (The Gulf 24).
