Sardinia Hunting Calendar 2011-2012: Caccia Ambiente writes to the Region of Sardinia a draft bringing about changes to the previous Sardinian hunting calendar.
On 24.06.2011, a draft was forwarded to the President of the Autonomous Region of Sardinia, Hon. Ugo Cappellacci and for information to the Councilor for the Environment Hon. Giorgio Oppi, a draft bringing about changes to the previous hunting calendar (2010/2011), which in our opinion is too restrictive.
Not only that, being that in the context of the "Sardinian Hunting World", there were "some proposals for a hunting calendar" (if they can be called so), much more restrictive than the previous one.
As reported in the accompanying letter: "This proposal arises from the need to improve the current hunting regulations, regarding the species and the relative sampling periods." Given the promises made during the electoral campaign, the law on "hunting in derogation" for the month of February gone adrift, we now demand concrete answers.
The Region must be able to make proposals, in the certainty of defending its reasons even before the European Court of Justice (as for example Malta did, winning the case), should it become necessary.
In this regard, it is necessary to work seriously in order to obtain the lengthening of the hunting season in the month of February, in the possible forms provided for by law. The current transposition of art. 42 and the integration of art. 18 with paragraph 1 bis LN 157/92, poses difficulties that must be overcome.
Also in this regard, the start of the operation of the Regional Institute of Wild Fauna will be able to make an important contribution, as the sentence of the Constitutional Court cites, which has expressed itself several times with sentence 17/01/1991 c-157/89 against the Italian State (hunting until March 10), sentence no. 536 of 27/12/2002 (February hunting), judgment c-435/92 of 19/01/1994, in which it is reiterated that the choice of the national legislator to extend hunting for some species of migratory birds beyond 31 January , MUST be "endorsed by technical-scientific data appropriate to each species specific case".
This implies that for each species the period of reproduction and migration must be rigorously ascertained, in order to avoid the violation of Community Directive 409/79, which requires Member States to prohibit hunting "during the period of reproduction and during the return to nesting places ".
Also in order to avoid the various infringement procedures such as n. 2006/2131, Infringement procedure n. 2004/4242 (against the Region of Sardinia), Infringement Procedure no. 2004/4926 (against the Veneto Region). Above all it would serve to counteract certain "opinions" of ISPRA. Now, we did not feel like including the month of February in the hunting calendar, it would have been yet another taking for a ride.
It is necessary to be objective, and to understand that in order to hunt in derogation the Sardinia Region must put in place all those procedures required by law.
Probably the letter will not have the desired effects, even for the short time, but this (in our opinion) will give them more than an alarm bell (also given the result of the elections in Sardinia).
It is time for them to understand, that finally the hunters have their own political identity, and above all that we have reached the limit of tolerance.
