On April 28 the Lombardy Regional Administrative Court he issued a rather important sentence from the hunting point of view. The branch of Brescia was in fact called to evaluate the appeal presented by LAV (Anti-Vivisection League) against Province of Brescia and against the Provincial Farmers Union to cancel the containment and eradication plan for nutria.
We are talking about the deed issued on 21 January by the director of the Agriculture, Hunting and Fishing Sector of the Lombardy province. LAV also requested that the rules of this plan be canceled. The administrative judges found several anomalies in the riamendments to Annex A of the regional guidelines course. First of all, the environmental association was not deemed entitled to intervene to protect a species like the nutria, given that it is not protected and is considered to be destroyed as harmful.
Furthermore, the containment plan was found to be compliant with the Constitution: as underlined in the sentence, the containment is carried out not only by subjects indicated by the hunting law, but also by volunteer citizens (after following training courses). Consequentially, containment and eradication cannot be considered "hunting", unlike what LAV had explained. The latter was therefore ordered to reimburse the Province of Brescia, the Provincial Farmers Union and the Lombardy Region for the costs of the trial.
