The First Section of the Lombardy Regional Administrative Court it expressed itself on the appeal filed by an armory against the Ministry of the Interior, the Prefecture and the Bergamo Police Headquarters. The company asked for the annulment of a decree of the Questore which had revoked the public safety license for the repair of common firearms. In January 2017 the license was renewed for the owners, father and son: specifically it was also the possibility of sell explosive material and up to 60 long gun cartridges.
A few months later, however, it was found that the weapons were not registered in the register of daily operations. In particular, the list included carbines and several hunting rifles. Even the sections relating to the loading and unloading of explosives were not properly compiled in the register, missing 6400 cartridges. The conviction led to a fine of over 6 thousand euros. The judges of the TAR confirmed the presence of one violation of the law as regards the custody and circulation of weapons.
At the same time it has been recognized that armories register weapons in two moments, by inserting the form in the barrel and then by the closing time of the store. The revocation of the license was found to be disproportionate. The attention of the owners has decreased due to the practice of registering the weapons in two moments, also because the delivery could have taken place shortly before the inspection. Consequentially the appeal was upheld.
