Assoarmieri briefly ruled on the seizure of the M76 Zastava ordered by the Public Prosecutor of Brescia on the national territory.
When a probative seizure is carried out (pursuant to Article 253 of the Criminal Procedure Code), as in the case in question, the seizure decree ordered with a reasoned decree must contain:
- the laws that are deemed to be violated;
- the criminal offense, specifying the extremes of time, place and action of the fait accompli;
- the direct or pertinent relationship between the thing subjected to seizure and the crime committed.
Having made these brief considerations, it is necessary to reflect with absolute serenity on the decision taken by the Brescia Public Prosecutor's Office. But isn't it true that all short, long, smooth, rifled, semi-automatic guns are capable, with appropriate modifications, of firing in bursts, none excluded! If the weapon in question (like all the others) in its so-called “design position” or single shot is safe, it makes no sense to make a modification to prevent an action that is not there.
Among other things, it should be considered that one is able to remodel the weapon again thus recognizing in this case the possible crime of altering the weapon. If the weapon without any modifications cannot fire in bursts then that's okay, period! And then since 2003, when the cataloging by the Advisory Commission was done, has it been realized only today, after more than ten years, that something is wrong? Whose responsibility is it? In the history of our country, how many Zastava weapons have perhaps been fired to commit acts of terrorism? The negative answer is implied!
We must seriously worry about other so-called "sensitive" situations, aimed at terrorism and not "embark" on a seizure of a whole series of carbine which have been imported into Italy (Zastava mod. M76 and GM Tecno Mod. GM76) and which are found on the Italian territory for a number that well exceeds 1.200 pieces! Once placed under seizure, the weapons will hardly be returned as they were confiscated and then subsequently destroyed. We will face a huge expenditure of public money, ours, to issue the order to go door to door and have the rifles in question, from Bolzano to Agrigento!
But not only that, how much will the technical advice given to those who have the ability to grab a bone with such a succulent pulp ever cost? It will be appropriate, for our economic serenity, too, to entrust the specialized departments of the Armed Forces and Police with the possibility of appraising these weapons at no cost without, therefore, further burden for citizens!
Pure madness, not only this but also not getting to mild advice with those who wanted to promote and wanted to blow off the ashes of a fake problem. Not to underline the practicality of some basic concepts on the subject of weapons such as those of "Design defect" and "Execution defect" in the operation of the weapons, knowing perfectly well that by modifying semi-automatic weapons, the weapon itself is removed from safety, risking that everything can explode in your hand, as instead, this affair which begins today also risks imploding throughout the national territory and we do not know when it will have its epilogue in the interest of all the people involved.

For my part, from the day of the seizure 02/10/2014, I have not bought any magazines or anything else, despite the passion,
