The First Section of the Regional Administrative Court of Umbria expressed itself on the appeal lodged by a man against the decision of the Perugia Police Headquarters who had rejected the request to release the rifle port for skeet shooting use. The facts are soon told. According to the administration, the no to the firearms license was motivated by the danger of abuse, given that the father lived in the palace of this person, convicted of threats and recipient of an equal prohibition of possession of weapons.
The applicant showed the judges all the precautions used in the guard their weapons, so as to ensure reliability. The appeal was accepted by the Umbrian TAR, given that the revocation of the authorization can be supported by a series of particular circumstances, including living with family members who have a criminal record.
The license holder, however, has shown that he has set up an armored cabinet to keep his weapons, with keys of exclusive availability, so as to convince the administrative judges that the man's father has no access. The police headquarters, on the other hand, had deduced the abuse of weapons from simple coexistence, without evaluating these other details. Acceptance of the appeal effectively annulled the contested provision.
