Luca Stincardini, president of the Migration Commission of theNational Free Hunting Association, and Alessandro Fulcheris, president of the regional section of Toscana of the ANLC itself, have issued a press release relating to hunting calendar. Here is what you can read: “From a subsequent examination of the hunting calendar of Tuscany, in our opinion there is something wrong. Rereading the article, in fact, we noticed that there were two important oversights in drawing up the hunting calendar for the 2018/19 season. These are technicalities that we consider fundamental, present in the previous calendars and missing in the past season which was the subject of the notorious appeal of the animal rights party.
The first concerns the legal justification relating to paragraph 2.7.10, incomprehensibly replaced with "The overlap of a decade with the pre-nuptial migration period indicated in the Key concepts document and allowed by the Interpretative Guide document" (par 2.7.9). The use of the overlapping decades relating to par 2.7.9 and 2.7.2, are used exclusively, for those species which have a KC at the beginning of the third decade of January (ducks for example), which paragraphs, if applied, authorize the Region a close the hunting season to January 31st. If not used, the season ends on January 20th.
It does not seem correct in this case, nor is it absolutely sufficient, to report it only in the premises of the act the paragraph 2.7.10, if then in the specific sheet of the woodcock species a paragraph is used which conflicts with the intention of depart from the National kc. Basically, to be very clear, the form only grants and justifies the decade of overlap on January 20th and not January 31st. Dangerous forgetfulness. Each species needs its own precise legal and scientific justification. Recalling that the compliance of the maximum time frame, referred to inart 18 law 157/92, in which, following the transposition of Article 42 of state law 96/2010, two new time frames were introduced, “minimum and average” referring to the national kc from which the regions can legally depart.
As regards also the "Second forgetfulness"; two high-level scientific publications are not cited, which serve as a further foundation for the regional ones and are instead present in the past articles. For speed of reading are reported below, and they can be compared with past calendars. It is clear that the card is no longer able to support the observations of animal rights activists, where a false application of par 2.7.10 is complained of. As citizens, who pay handsomely in advance for a service, we should, at this point the conditional is necessary, wait for a final product of application of the standard, devoid of any forgetfulness. The observation, among other things, is not only addressed to the Tuscany region, but to all the regional administrations. Up to now the report, so to speak scientific, made in collaboration with the ANLC Migration Office.
And if asking is lawful, and answering is courtesy, we ask those responsible for answers and we provide in attachment all relevant documentation. Why are some such important citations missing from the documents, having been removed? Let it be clear that ours are observations and that everyone can make mistakes, but if you resort to the Council of State on these bases you could really risk bringing the ship to a safe and safe shipwreck. with no more hope of re-emergence. Waiting for answers from the Regional Offices and the competent Department, we make ourselves available to the rest of the hunting association world in order to be able to implement common strategies and avoid escapes that could lead to very dangerous pronouncements ".
