Hunt in Forlì: the Council of State also gives reason to the Province on the Hunting Calendar and rejects the request for precautionary suspension.
The Province of Forlì-Cesena wins, even in the second degree, as regards the request for suspension of the hunting calendars. The Council of State, in the hearing on Tuesday in Rome, confirmed the rejection, already decided at the end of July by the TAR of Emilia-Romagna, of the request for the precautionary suspension of the hunting calendars of the Province of Forlì-Cesena, advanced by the League anti-vivisection (Lav) and the League for the Abolition of Hunting (Lac).
On the appeal of Lav and Lac, who had challenged the order of the TAR of Emilia-Romagna, the Fifth Section of the Council of State (Pier Giorgio Trova as president, Vito Poli as director, Paolo Lotti as director, Doris Durante as director and Fabio Franconiero as drafter) did not identify effective refutations of the TAR order and therefore confirmed the first judgment.
In particular, with regard to the failure to assess the impact on hunting calendars, merely suggested by Ispra (the Higher Institute for Environmental Protection and Research) in its opinion, the Province counter-deduced that this assessment was carried out in the implementation of the wildlife-hunting management plans and that the relative prescriptions are reported in the contested calendars.
On the second question, the use of non-toxic ammunition for hunting ungulates, it was argued that there is no regulatory ban at the state. Finally, for the selective collection of some ungulates, it has been counter-deduced that this collection is also allowed in derogation of the periods established in the framework law 157/1992 due to the state and regional legislation.
The arguments met with the favor of the administrative judges, who therefore rejected the appeal. The hunting calendars of the Province of Forlì-Cesena are therefore fully operational.
