The Sardinian TAR has in fact decided to suspend part of the regional hunting calendar with regard to the hunting of blackbirds and larks from 31 December 2011 until 1 February 2012, the day on which the hearing on the merits was set.
The suspension of the TAR wanted to accept the appeal presented by the animal rights association LAV, Anti-Vivisection League and obviously by other environmental associations such as WWF, Enpa, Lipu and Legambiente.
The intent of the environmentalists present at the first hearing with their representatives was to completely cancel the decree of 11 July with which the regional councilor for the Environment had issued the 2011-2012 hunting calendar.
Instead, the court decided to accept the precautionary petition but only for the part of the Hunting Calendar concerning hunting in derogation for the species of blackbird e lark.
Il the next step for the judges will be to assess the presence of any constitutional illegitimacy of the regional law with respect to national regulations, especially since the exemptions granted would have been approved in the self-established periods and without taking into account the opinion of ISPRA, the Higher Institute for Environmental Protection and Research.
At this point we just have to wait confident that even the Sardinian TAR will align itself with the decisions in favor of hunters as already happened in other regions during the current Hunting Season.
