The Regional Administrative Court of Liguria annulled the Regulations of the Province of Savona which governed the detention and use of wild birds used as live calls by hunters in hunting from stalking. The appeal was promoted by the environmental associations WWF and VAS (Verdi Ambiente e Società), sponsored by the law firm of the lawyer Daniele Granara of Genoa.
The TAR found various points of illegitimacy of the provincial administration regulations, including: the failure to obtain the mandatory opinion of the Higher Institute for Environmental Research (ISPRA), provided for by regional hunting legislation; the exclusion of voluntary hunting guards and other public supervisory bodies from the tasks of checking and verifying compliance with the regulation, since the Province of Savona has illegitimately restricted the supervisory functions regarding the use of live calls to the administrative staff of the Province only; the fact that the Province has canceled the previous prescriptions for the suitable keeping of animals in cages or aviaries of adequate and larger size, when live calls are not used for hunting (hygiene and health regulations, prohibition of iron cages, possibility of open the wings, etc).
