The Regional Administrative Court of Umbria rejects the hunters' appeal and declares the increase in the registration fee to the ATC Terni legitimate.
With its own sentence, the Regional Administrative Court of Umbria declared the increase of 25.82 euros lawful for the registration fee to the Territorial Hunting Area 3 of the Province of Terni, thus rejecting the appeal presented by the hunters.
According to the hunters' appeal, the increase in the registration fee should have been determined according to an agreement between the provinces of Terni and that of Perugia and with the possible support of the hunting world so that there were no disparities between the hunters of the two provinces. .
On the other hand, it has been verified that the increase in quotas imposed only for the province of Terni has created an inequality of treatment with respect to Perugian hunters; furthermore, the increase in the quotas was approved after the expiry of the terms for registration with the ATC when the quotas had already been paid according to the previous tariff. According to the TAR ruling, the agreement between the two Provinces is equivalent to a "procedural competition on the definition of quotas which, however, is not the same as saying that they must be identical".
In addition, the TAR also clarifies the concept of sharing with the hunting world of the increase in quotas by explaining that "Sharing does not mean unanimity or universal suffrage, all associations, except one, have examined and approved the variation of the contribution".
Finally, as regards the question of the increase after the registration deadline, according to the judges of the Administrative Court, there is no formal defect as "there is no rule that provides for mandatory terms for determining the contribution".
