La Court of Cassation intervened in the last few days to clarify some of the main aspects of the arms transfer from one place to another. According to the judges of the first criminal section, the maximum term, equal to 72 hours, for the transfer in question. Instead of sticking to these three days, it is necessary to act as quickly as possible.
The ermine sentence is related to article 38 of the TULPS, according to which there are two situations with which you may have to deal: the first is the one that requires the weapon to be reported within 72 hours from the moment it is in possession, while the second consists in the repetition of the report later to the aforementioned transfer. In the first case, there is a tendency to ignore the identity of the owner of the weapon and, in some situations, even the existence of the same.
In the second, however, there is information to be updated on the place where the weapon is kept. As underlined by the Supreme Court, then, “in the event of the transfer of the weapon duly held, it is not possible to identify a moment in which the material availability of the weapon is acquired". The pronouncement will be fundamental for future measures and for the legal compliance of all gun owners.
