The detached section of Brescia of the Lombardy Regional Administrative Court expressed itself on the appeal of a man against the Ministry of the Interior and the Prefecture of Brescia against the prohibition of possession of any type of weapon, ammunition and explosive material. It all started after discovering in this person's house some weapons stored correctly, but not reported. The appeal referred to the absence of situations that could have led to a improper use of the weapons themselves.
The man is a member of Sedilo's self-managed hunting (in the province of Brescia) and the holder of the license that allows him to transport the weapons within the State and use them for hunting purposes. from 1st September to 31st January. According to the judges of the TAR, when the transport is not instrumental to the exercise of the hunt, but determines the conservation in a place other than that indicated by the owner, communication is necessary.
In particular, the change in the place of conservation must be communicated in a timely manner, even if it occurred for a limited period of time. The man's appeal was therefore rejected, with the same applicant being sentenced to pay court fees (1500 euros to be precise).
