The vote in the House
Special laws regarding animals will not be repealed. The House Justice Committee, with the approval of the Government, voted in favor of their maintenance. In the referring body, the Second Justice Commission of the Chamber approved an amendment presented by the Hon Carolina Varchi (FDI) and the Hon Francesco Bruzzone (Lega) entirely suppressing article 7 which would have repealed article 19-ter (Special laws regarding animals) of Royal Decree 601/1931. Its repeal would have classified some activities as crimes, such as the slaughter of animals in relation to the crime of killing animals.
Assent
The rapporteur of the PDL Hon. Michela Vittoria Brambilla expressed a favorable opinion on the suppressive proposal formulated by the Hon. Varchi and Bruzzone. The Government, represented in the Chamber by the Deputy Minister of Justice Francesco Paolo Sisto, also expressed an opinion in agreement with that of the rapporteur. Article 19-ter is a safeguard rule introduced by law 189/2004 against the mistreatment of animals. The aim is to exclude the application of the penal code to the cases provided for by the special laws regarding hunting, fishing, breeding, transport, slaughter of animals, scientific experimentation on them, circus activities, zoos. Title IX-bis of the Criminal Code on crimes against animal sentiment does not apply to these cases.
Conclusion of the process
The same article 19-ter excludes the application of Title IX bis of the Criminal Code also to historical and cultural events authorized by the competent region. Furthermore, as a result of the approved amendment, the provisions of Article 10 of PDL 30, aimed at extending the administrative responsibility of entities to crimes against animals, will not even apply to special cases. The bill will not be scheduled in the chamber on Monday 18 March. The examination times are lengthening as reported by the President of the Justice Commission, the Hon Ciro Maschio: "There are no conditions to conclude the process of the provision in time with respect to the forecast of starting the examination in the Assembly by Monday 18 March, as currently planned” - he explained.
