La Law of the Veneto Region number 11 of 2016 it is not even a month old (it was officially approved last March 15) and is already at the center of a political controversy. This is the regulatory text that governs fixed positions for hunting purposes in the territory of the northern region, introducing some amendments to law 50 of 1993 relating to the protection of wildlife and hunting. Well, the regional councilor Andrea Zanoni (Democratic Party) believes this law is unconstitutional as it would have been violation of the division of competences between the State and the Regions. Furthermore, the law would have ignored a sentence of the Constitutional Court that had ruled on the matter. This belief is shared by the senator Laura Puppato and a question to the Minister of the Environment signed by Cirinnà, Granaiola, Amati, Santini and Dalla Zuanna.
As can be read in Zanoni's official note, the regional law has established that fixed positions for hunting can have a maximum size of 12 square meters and they can be taller than ten meters. According to the councilor it is about "A small house", an ironic joke to highlight the disproportion of the choices made just over three weeks ago.
Another complaint concerns the absence of prior authorizations for what concerns the landscape point of view, therefore a clear violation of national law 221 of 2015 ("Environmental provisions to promote green economy measures and to limit the excessive use of natural resources"), a text that does not extend the competence of environmental impact to the regions and landscaping of buildings. The statement also explains which part of the Constitution must be read to understand the reasons for the question in the Senator. It is one of the most famous articles of the Charter, the 117 (the one that speaks of legislative power).
For Zanoni and the other signatories, the article is clear in the outline the responsibilities of the state and regions, but the Venta law would have decriminalized a building intervention that is considered illegitimate by national legislation, also putting the provinces out of the game. The request to the Renzi government is to raise the question of unconstitutionality as soon as possible, given that Veneto would be systematically violating European and national laws to "favor the most backward part of the hunting lobbies". The controversial law of last March 15 consists of two articles, the first dedicated to the inclusion of a new one relating to the protection of wildlife for hunting purposes and the second dealing with the financial regulation.
