What is unfortunate is to see that the Councilor and Offices still have not yet understood what happened and how administrative justice works: they continue to confuse the precautionary measures with the decision on the merits. And sorry to note that they have not understood anything of what we wrote to him in May and July.
That the deadline of June 15 for the publication of the calendar is not peremptory and that a calendar adopted in September is still legitimate was not in doubt even then, but publishing it so late does not allow us to examine any appeals in time and is justified the adoption of precautionary measures such as the one adopted by the President of the Regional Administrative Court, regardless of the actual validity - even if only on the face - of the appeal. Now that the TAR has only partially accepted the grounds of appeal of the LAC, we have black yes white the certainty not that the Region has acted correctly by publishing the calendar 2 days before the opening: far from it! We are certain that if he published the calendar as soon as possible (early August) the TAR would not have suspended the entire calendar, but at most only those provisions rejected today.
In short, the sentence today certifies that if we have lost 10 days of hunting it was exclusively because of the - infamous - choice of Department and Offices. And should we apologize? And the sentence, while contradicting itself, essentially recognizes a role and power in ISPRA that go far beyond those provided for by Law 157/92: if any other association sees a glass half full, I see a bottle in which the wine is running out. I fear that the Councilor's statement is still the result of the bad advice he receives: after all, the LAC rejoices at the sentence because it won, the Region rejoices at the sentence because it won ... Perhaps in the Region they confused the case with the TAR with the elections, where everyone is known to win.
And as always, in short, only we hunters would have lost, defrauded of 20 days of hunting turdidae (10 at the bottaccio in September and 10 in Sassello and Cesena in January), 10 days of hunting for sedentary and aquatic birds in September: but after all, remaining on the electoral theme, we know that the voter-hunter is the favorite destination of the pre-nuptial migration of the Padùlo bird (Turdus pàdula).
