Uno Law Firm, on a mandate given by numerous hunters, has provided for the forwarding of a formal warning to all regional and national bodies, including the Minister of Agricultural, Food and Forestry Policies Teresa Bellanova, the President of the Council of Ministers Giuseppe Conte and the President of the Regional Council of Campania Vincenzo De Luca. For the 2020/2021 hunting season, as indicated by the regional hunting calendar, all hunters paid the sums necessary for the regular performance of the hunt. Specifically, they paid the government grant tax, the regional one as well as any other tax and / or tax aimed at obtaining the various legal authorizations for carrying out the aforementioned activity both in the regional territory and outside the region.
Due to the health emergency from Covid-19, the Government ordered the blocking of hunting activities in the "red zones", a block which therefore prevented hunters from Campania from carrying out this activity from 3.11.2020 to 6.12.2020. Such an impediment appeared completely unjustified due to the foreseen possibility of carrying out sports activities pursuant to art. 1, paragraph 9, letter d) of Prime Ministerial Decree of 3/11/2020, allowed as long as they are carried out in compliance with anti-covid regulations. Well it is well known that the hunting activity is carried out outdoors with the possibility of an interpersonal distance between the participants much greater than that necessary to avoid contagion, therefore the rationale of the blockade imposed by the Government.
To date, with the passage of Campania into the "orange zone", hunting is allowed only in the municipalities of residence and / or domicile. It should also not be overlooked that, with specific reference to wild boar hunting, the hunting activity represents an indispensable useful tool to stem a safety problem given the damage caused to crops, road accidents and the spread of swine fever: consequences of an uncontrolled spread of these animals which requires containment. For these reasons, the Gazzella & Partners Law Firm has requested all the regional and national bodies in charge, each for their own reasons and competence, to have: the possibility of exercising hunting activities even in municipalities other than that of residence and / or domicile of the hunters; the extension of the hunting calendar to the months of February and March 2021; the full reimbursement of the sums paid by hunters by way of taxes and / or duties for the 2020/2021 hunting season, in the event of failure to adopt the previous measures.
