The possibility of exercising the withdrawal in derogation is not a mirage and it is absolutely not true that it is now impossible for the Regions concerned to prepare and approve the necessary measures in time for the now imminent official start of the 2013/2014 hunting season. All the technical and legal conditions are in place to overcome the latest difficulties both at Community and regional level. But to do this you need a sense of responsibility and the courage to say things as they are to hunters without deceiving them with demagogic promises, with unsustainable proposals or fomenting their justified discontent by playing at the blame for political responsibilities between the institutional levels involved (European, national and regional). ), because doing so does not solve the problems but, on the contrary, we only risk losing forever the possibility of keeping our traditional hunts alive.
If we want, today as today, to give basic certainties to hunters (and then with effort and commitment to climb the slope and regain new and greater opportunities for the future), whether we like it or not, unfortunately it is not possible to ignore some conditions that the EU Commission has requested, responding with recent communications to the Lombardy Region and the Veneto Region, to be respected for the approval of a regional resolution on the levy in derogation 2013 which, in a nutshell, are the following: Limit the levy in derogation only for hunters actually interested in this form of sampling.
An upper limit of 15-20 percent of the total number of hunters in each region may be sufficient to satisfy both sides. The sampling should take place only from a fixed and temporary posting (pre-indicating the place of realization) in order to facilitate the controls provided for by the legislation, taking into account, in any case, the need to comply, in the relationship between the quantities that can be collected and the plants authorized to withdrawal, the principle of the small amount that can be withdrawn.
The marking of the animals withdrawn by way of derogation must be carried out immediately after "the killing act" and the recovery on a special "carnet" (or on the regional hunting card). Harvesting periods must be defined that coincide with the "full pass" period of the species concerned. The species must be identified among those that enjoy a favorable state of conservation and the calculation of the small quantity that can be taken can be made directly by the Regions on the basis of quotas that have long been subject to a strict monitoring system, as hypothesized in the reply of Commissioner Potocnik ( n. E-004671/2013-I) that provides adequate and relevant data as for the species resident in the Veneto and Lombardy Region (bird resident) or on the basis of what is stated on p. 89 of the Interpretative Guide of the Directive (English version) where an example is given for the calculation of the small quantity for the Porciglione species.
The EU Commission has also given its availability for the widest collaboration for a correct application. We therefore ask you to participate with determination in these meetings in order to close the game at the community level and then guarantee the same determination at the regional level, respectful of European dictates, of hunters' expectations and at the same time fully sustainable in the competent fora.
