The Fifth Section of the Regional Administrative Court of Campania accepted the appeal of a hunter denounced by the hunting guards of the LIPU with allegations of robbery and other crimes. The disputes had started the trial against the man, acquitted after some time with full formula for not having committed the deed. But what exactly happened? Despite the acquittal this person had not been able to regain his hunting license, since the Carabinieri had denied the renewal, as well as the Ischia Police Headquarters.
The appeal to the TAR was not easy, also because the police have a large discretion from this point of view. However, the judges assessed the case objectively. The hunter was in danger of suffering very serious and irreparable damage, which is why his position had to be protected at all costs.
The license suspension was canceled and the appeal will be dealt with on the merits at the end of the year, to be precise next 6 December (therefore in eight months). Pending the new hearing, however, the man will be able to renew his firearms license: his position has been carefully reviewed and this ruling could become a determining precedent to be inspired by in identical situations.
