Caccia: Abruzzo, Febbo "The rulings of the TAR and the Constitutional Court concern past management".
“In order to clarify any misunderstandings, I intend to specify that the sentences recently filed by the Abruzzo Regional Administrative Court and the Constitutional Court both refer to activities of the Regional Structure dating back to previous periods. In fact, the ruling of the Constitutional Court found the constitution of the “Single Section for migration” to be unfounded, which took place as a result of LR 106 of 2005 which amends by integrating art. 43, paragraph 6 of Regional Law 10/2004. It is obvious that the responsibility for the decisions of the time cannot and should not be attributed to those who currently deal with and worry about the matter ”. This is what the Regional Councilor for Hunting, Mauro Febbo declares regarding the news relating to the judgments of the Constitutional Court and Tar Abruzzo on hunting activities. “As for the ruling of the TAR - continues Febbo - referring to the appeal against the 2009/2010 hunting calendar, it is good to say that the error found in the calendar stems from an incorrect reading of art. 18 bis introduced to Law 157/92 in 2009, which established different hunting periods for migratory species and which, due to its limited clarity and wide margin of interpretation, in 2012 induced 11 regions to produce hunting calendars, among them similar, observed in as many adverse appeals ".
"For the peace of mind of the various stakeholders - concludes the Regional Councilor - in the matter of allowed and controlled hunting, I can say that the capacity and awareness of this Department and the competent regional structures has grown to operate in absolute compliance with Community and national regulations, with a technical-scientific management of the matter. This is achieved through the assiduous and fruitful collaboration with those who are institutionally responsible for the management and protection of the environment and fauna, including ISPRA, and who have produced protocols and projects aimed at the management of individual species such as the Rock Partridge project, the Lepre Italica project, the establishment of the Technical Roundtable for PATOM, action B1. "
"In addition, - concludes Febbo - in order to respond and comply with the Ministerial Decree of 27/11/2012, the administrative structures of this Department have equipped themselves with a computerized program for the collection, management and access, also of the Institutions, of data referring to the killing that occurs during the hunting season which allows a careful and timely monitoring of the conditions and evolution of the state of the various animal species in the area ".
