Hunting and Weapons: Assoarmieri in its own note summarizes the new legislation on Weapons in terms of magazines for pistols and rifles in view of the imminent, (November 5, 2015 ed.), full application of Legislative Decree 121/2013 and the amendments to article 38 of the TULPS introduced by law 43/15.
Below is the summary table of the new legislation relating to the correct management of loaders drawn up by Assoarmieri:
LOADERS: if with a capacity greater than 5 ammunition for long guns and 15 for short guns, if provided for weaponry for sporting use, antique and replicas of antique weapons, can be sold without the obligation to record in the register of daily operations by the gunsmith but must be reported by the holder.
The keeper may use these magazines in sporting firearms or common firearms not complying with the shot limit acquired before November 5, 2015. This also applies to magazines intended for gas or compressed air sport firearms with a capacity greater than 5 shotguns. long and 15 for short weapons. For the utmost caution, however, it is suggested not to use these magazines in firearms conforming to the number of rounds. We strongly advise against the sale of magazines with a capacity greater than 5 cartridges for long guns, 15 for short guns and 10 for replicas of ancient weapons.
TANKS: fixed irremovable tanks with a capacity exceeding 5 cartridges of long rifles qualified for shooting for sporting use pursuant to law 85/1986, whether they are smooth-bore or rifled, being an integral part of the weapon itself, must not be reported separately.
PLATES: the plates are manufactured technologically different from a magazine (they do not work if not inserted in the immovable tank and therefore they are comparable to a small part of the tank itself, or to a system for the rapid filling of the magazine / tank). Platelets are therefore not subject to the provisions of Law 43/2015. For the utmost caution, it is advisable to sell and use weapons with Mannlicher type tanks (Carcano, Steyr-Mannlicher, Garand rifles, etc ..) equipped with plates with reduced capacity to five shots.
"SPORTS" SHORT WEAPONS (qualified shooting pistols for sports use also with gas or compressed air pursuant to law 85/1986): they can be equipped with a magazine of more than 15 cartridges (if required by the classification sheet). In this case, from 5 November 2015 the possession of magazines intended for such weapons with a capacity exceeding 15 cartridges, also the service one must be reported by the keeper. For the acquisition / sale of them, there is no obligation to record in the register of daily operations by the armourer;
"SPORTS" LONG WEAPONS (Rifles and rifles with smooth or rifled bore, gas or compressed air qualified for shooting for sporting use pursuant to law 85/1986): they can be equipped with a magazine with a capacity greater than 5 cartridges. In this case, the possession of magazines intended for such weapons with a capacity exceeding 5 cartridges, even the service one, must be reported by the keeper. For the acquisition / sale of them, there is no obligation to record in the register of daily operations by the armourer;
"COMMON" COURT WEAPONS (not classified as sporting): from 05 November 2015, the sale or transfer afterwards of short firearms with magazine capacity exceeding 15 cartridges will be definitively prohibited. Such weapons in stock in the armory with a magazine of higher capacity, can only be sold if equipped with a limited magazine to hold a maximum of 15 cartridges.
The holders of non-classified sporting short firearms acquired before 5 November 2015 may use magazines with a capacity exceeding 15 cartridges in them (such magazines must be reported). From 5 November 2015, holders of common weapons will be able to sell these weapons only if equipped with magazines with a capacity not exceeding 15 cartridges.
"COMMON" LONG WEAPONS antique weapons are not subject to the loader conformation obligation and / or "(HUNTING rifles and rifles with smooth or rifled bore or common long guns with gas or compressed air NOT classified as sporting): from 05 November 2015 it will be definitively prohibited the sale or transfer of rifled or smooth-bore hunting long guns with magazine or fixed tanks with a capacity exceeding 5 cartridges. Such weapons in stock in the armory with a magazine or magazine of higher capacity, can only be sold if equipped with a magazine or magazine limited to contain a maximum of 5 cartridges.
Owners of non-classified sporting long guns acquired before 5 November 2015 may use magazines with a capacity of more than 5 cartridges (magazines subject to notification) in such weapons. From 05 November 2015 the holders of non-classified sporting long common guns will be able to sell them only if with the magazine / magazine conformed to a capacity not exceeding 5 cartridges.
ANCIENT WEAPONS: both long and short ancient weapons are not subject to the obligation of conformation of the magazines and / or tanks REPLICAS OF ANCIENT WEAPONS: these weapons can be sold after November 5, 2015 only on condition that the removable magazine or the fixed tank cannot contain more than 10 cartridges.
LONG WEAPONS DEMILITARIZED (not classified as sporting): these firearms cannot be sold equipped with magazines with a capacity greater than 5 cartridges even if acquired before November 5, 2015. For demilitarized long firearms classified as sporting, the same provisions apply as for sporting long firearms.
