The Municipal Councilor of Sant'Agata dei Goti, as well as the Regional Vice President of ANUU, Cesare Serino in his own note puts forward a proposal on the issue of the Campania ATCs.
Serino's note reads, "With article 34 of Regional Law number 1 of 2012 (Finance Law), the Campania Region has further taxed the hunting category, further limiting it with the increase in taxes for the granting of the right to exercise of the activity ".
"It is well known that under the laws in force, the repeal of a law cannot take place with a simple appeal challenged among other things on behalf of associations. In this case, speaking of the above article, it falls within the financial law and therefore a hypothesis of abrogative referendum is absolutely not allowed, as the abrogations of the financial laws are inadmissible ".
The councilor continues on the issue, "In recent days, in fact, some hunting associations have the intention of filing a series of appeals or referendums against article 34 of the Finance Law of the year 2012 of the Campania Region: would be automatically rejected as there is no appeal against a regional budget law and if possible an institutional body should do so. We regret the spread of initiatives without a logical and legal basis ".
Continuing states Serino, "It is a further slap in the face of the cultural morality of a part of the population who, with great sacrifice, devote themselves to a passion, the art of hunting, which has already been significantly penalized.".
The councilor then urges, "The question is very simple: if in the Regional Law number 1 of 2012 of the Campania Region (Regional Finance Law) article 34 was drawn up for purposes related to the hunting world, surely someone has pleaded the case and with the support of pertinent consultancy the argument treated. It is therefore necessary to go back to the origin of the argument and certainly some hunting association has expressed an opinion on the matter. In fact, the same article mentions the proposal to include ENCI in the management committees of the Territorial Areas of Hunting ".
He therefore hopes Serino "I believe it is essential only in order to avoid a further sinking of the category to unite the whole hunting world and in a simple way hope in the formulation of a valid regional legislative proposal that unites all the needs formulated by the hunting category. There are various proposed amendments to the Regional Law 8/96. In this case there is the proposed law number 270 of 2011, entitled "Amendments to the Regional Law April 10, 1996 number 8" ".
The councilor continues explaining, "This law proposal with the aim of being able to re-evaluate the hunting tradition in Campania which has always been mainly aimed at migratory venable species and taking its cue from the regional law that governs the hunting activity of a neighboring region, Puglia, wants to give hunters residing in Campania the possibility to carry out the aforementioned activity aimed at migratory fauna on all territories of the regional hunting territories, in a simple and concise way, upon payment of a fee equal to that of the registration in the hunting area of hunting residence. This rule will obviously not apply to sedentary fauna, subject to the hunting density index, which therefore will be allowed only to those authorized in the chosen hunting area ".
Serino adds on the issue, "The bill also aims to change the composition of the Management Committee of the Territorial Areas of Hunting. In order to favor the widest participation in the choices of wildlife hunting planning, all the hunting associations present in the national wildlife hunting technical committee referred to in law 157 of 1992 will be able to give their contribution ”.
Counselor Serino continues in the explanation, "It is clear that these changes will allow an increase in hunting tourism for the benefit of the activities connected to it and in particular there will be ample participation in the decision-making process in the management of the hunting fauna choices of the territorial hunting areas (ATC). This proposal for a Regional Law does not involve a commitment to spend on the regional budget. Nor will an increase in hunting associations within the ATC management committee lead to waste of public money, as the ATCs are supported by the funds paid by the hunters themselves, which belong to all associations and not just some ".
Finally, the councilor adds, "Participation is synonymous with democracy and transparency. Only this proposal will appease the hunting world in Campania and all its related activities, with just a simple modification maneuver ".
Serino finally concludes with an invitation, "The occasion is propitious for me to invite all the provincial and regional political offices of Campania to evaluate this proposal, which is validly decisive and in particular I invite the competent regional commission to take action as quickly as possible for the hearings of the industry associations. Only participation in concertation can determine equilibrium".
