(Wildlife hunting planning. Implementation tools)
1. The objectives are pursued by:
a) the destination of a share of regional agro-forestry-pastoral territory, not less than twenty percent and not more than thirty percent of the total, to protect wildlife. This percentage includes territories where hunting is in any case prohibited, also due to other laws or provisions. By protection we mean the prohibition of killing and capture for hunting purposes accompanied by measures to facilitate the stop of the fauna, the reproduction and the care of the offspring;
b) the allocation of a maximum quota of ten per cent of the agro-forestry-pastoral territory of each province to the establishment of structures for the private management of hunting;
c) the destination of the remaining part of the regional agro-forestry-pastoral territory to forms of planned hunting management provided for in article 36 and following.
1 bis) Within six months from the date of entry into force of this provision, the Regional Council will redefine the boundaries of the areas intended for the protection of wild fauna of regional competence, in order to comply with the criteria referred to in paragraph 1 and to rebalance the distribution of the same throughout the entire regional territory.
2. The ten per cent share of the territory to be allocated to private management is subtracted from planned management as soon as private management structures are authorized and established.
(Control and prevention of damage from surplus wild boar populations)
1. The Regional Council, in order to monitor the surplus wild boar populations and the related damage, shall, through the competent regional offices, arrange for the collection, archiving and computer processing of the relative data:
a) wild boar populations;
b) damage caused by this species;
c) the related killing carried out both in ordinary hunting and selective control regimes. Information is provided every six months by the Provinces, ATCs and by the management bodies of the national and regional protected areas.
Woodcock hunting is allowed from 7,30 to 16.00. Woodcock posting or stalking snipe hunting in any form is not permitted.
The training of pointing, hunting and following dogs is allowed, in the territories where there is no ban on hunting and there are no crops in place, in the period allowed for hunting, excluding days of hunting silence. The Provinces, with a provision of the Council, may authorize the advance up to forty-five days, with the exception of Tuesdays and Fridays, of dog training activities in limited areas after having ascertained the absence of specimens of wildlife in the nesting or nesting phase. dependence of offspring on parents.
(Scheduled hunting management)
1 The Regional Council, on the opinion of the competent council commission, after consulting the CTFVR, divides the territory intended for planned hunting, as per paragraph 1, letter c) of article 9, in ATC, intended for planned, surface hunting. not less than 45.000 hectares, even falling in several provinces or divided into sub-areas, possibly homogeneous and delimited by natural borders.
2. Every hunter residing by birth in Campania has the right to access with hunting residence, for the entire hunting season, in one of the ATCs established in the Region. The request must be made to the Provincial Office competent for the ATC requested, from February 1st to March 31st of each year, also indicating the order of preference for each other ATC In the absence of an application, the request relating to the previous year it is considered confirmed for the current year. Elements of the request that no longer correspond to current events, or the non-payment of the participation fee, invalidate the request and determine the obligation to reformulate it. Hunters enrolled in an ATC of Campania may be allowed, within the limits of the availability of places and subject to the consent of the management bodies, to hunt migratory birds, in an ATC other than the one they belong to, upon payment to the Region of a fee equal to that paid for the hunting residence and communicating the payment details no later than August 31 of each year under penalty of exclusion.
Hunters admitted to an ATC in Campania for the entire hunting season, by paying the Region an additional fee equal to the participation fee, can hunt, exclusively on migratory birds, in other ATCs, at their choice, for fifty days; this right is subject for each day to the availability of places and to the prior consent of the management bodies in compliance with the daily hunting density.
In order to rationalize and contain the expenditure of public administrations, to achieve an improvement in the balances of the budgets of each administration, contributing to the process of public finance reorganization, participation in the committees and management bodies provided for by this law is entitled free.
