Il TAR of Lombardy has ruled in favor of LAC and against the Lombardy Region on the question of migratory hunting on mountain passes with this sentence, judgment of passages n.2342.2020. It is thought that the Lombardy Region will appeal to the Council of State to try to overturn this penalizing sentence for Lombard hunters. The Regional Court accepted the arguments of the LAC onnon-compliance by the Region with regard to the obligation to prohibit hunting on all crossings. Once again it is the judiciary that takes concrete action to ensure the protection of wildlife and compliance with Italian and European laws, welcoming the requests of the League for the abolition of hunting.
The sentence of the Lombardy Tar n. 2342/2020 of 28.11.2020 has in fact fully accepted the appeal of the LAC handled by the lawyer Claudio Linzola for obtaining, decades afterintroduction of the national standard that protects them, the protection of the passes throughout the Lombardy region; for the protection and closure of all forms of hunting in these vital crossing points of the routes of migratory birds. Some of these "saddles", among the most important of all, are found in Bresciano and Bergamasco, and are still unprotected or alternatively subject to laughable limitations of hunting. In addition to the sentence of the Region to pay the expenses, the fourth section of the TAR also sent its pronouncement to the Court of Auditors, thus pointing out the repeated behavior of a regional administration which, "with choices that do not comply with sector regulations, causes considerable damage not only to wild animals, but also to taxpayers' pockets".
On the one hand, the continuous victories reported by Lac in the courtrooms; "On the other hand, a continuous waste of public money by the Region, always ready to give gifts to hunters, an increasingly small armed and intransigent minority compared to the majority of citizens who, on the contrary, can no longer stand hunting ”. The TAR accepted the theses of the LAC on the non-compliance of the Region regarding the obligation to prohibit hunting on all crossings, pursuant toArticle 21, paragraph 3, of Law 157 of 1992, the national framework law on hunting, “and rejected the pretext that invoked the need for the regional council to approve the wildlife plan: a document that has never existed since 1992.
Not only that: the administrative judges have ordered the immediate implementation of the ban, in fact, it is written in the sentence: "The issues relating to the regional and territorial hunting wildlife plans (articles 12 and 14 of the same regional law of 1997) must be cleared immediately, in which, as provided for by the aforementioned provision, the must be indicated, as well as in hunting calendars, without this implying that, in the absence of such acts, the crossings must not (in advance and regardless) be fully identified and protected and that the hunting ban that concerns them may not be observed ".". In the case of the Region and the Province of Sondrio do not comply within the terms established by the judicial order, an ad acta commissioner will be appointed due to persistent inaction.
